Govt waives clinical trial requirement for several drugs approved in select countries
The government has waived the requirement for clinical trials of certain categories of drugs in India if they are approved in the US, the UK, Japan, Australia, Canada and the European Union.
The waiver only covers five categories -- orphan drugs for rare diseases, gene and cellular therapy products, new drugs used in pandemic situations, new drugs used for special defence purposes and new drugs having significant therapeutic advances over the current standard care.
This waiver would ensure expeditious availability of the latest medicines for treating diseases like cancers, rare diseases like Spinal Muscular Atrophy (SMA) and Duchenne Muscular Dystrophy (DMA), and autoimmune conditions in India.
"As per Rule 101 of New Drugs and Clinical Trials Rules, 2019, the Central Licensing Authority, with the approval of the Central Government, may specify, by an order, the name of the countries, from time to time, for considering waiver of local clinical trial for approval of new drugs under Chapter X and for grant of permission for conduct of clinical trial under Chapter V of the said rules," the Drugs Controller General of India (DGCI) said in an order issued on August 7.
"In exercise of the powers conferred under Rule 101 of the said rules with the approval of the Central Government, the countries namely USA, UK, Japan, Australia, Canada and EU are hereby specified for following categories of new drugs," it said.
Presently, several medicines already approved by other regulatory authorities in the US, the UK and the EU are not immediately available for Indian patients because of certain regulatory requirements under the Drugs and Cosmetics Act and rules made thereunder.
These include the requirement of conducting a local clinical trial and generating safety and efficacy data before marketing authorisation in India, an official explained.
However, Rule 101 of the New Drugs and Clinical Trials, 2019, allows the DCGI to specify certain countries for considering waiver of local clinical trials for approval of new drugs.
"The advantages of operationalising this rule are that the latest medicines to treat diseases like cancers, rare diseases like SMA and DMA, and autoimmune conditions will become available expeditiously in India.
"One particular agreement on customs procedures...": MEA on India-New Zealand trade ties
In an effort to bolster trade ties, India and New Zealand are set to ink an agreement on customs procedures, the Ministry of External Affairs said on Thursday.
The agreement comes on the heels of President Droupadi Murmu's visit to the island nation.
MEA Secretary East, Jaideep Mazumdar on Thursday said that both countries are interested in helping the farmers of both countries to export things like fruits and vegetables.
"During this visit, we are signing one particular agreement on customs procedures which would certainly assist trade between the two countries and we wish to proceed step by step to see what other things we can do. Certainly, on both sides, we are both interested in helping our farmers to export things like fruits and vegetables to one another at the moment," Secretary East said at a special briefing on President Murmu's visit to New Zealand.
He said that the Free Trade Agreement (FTA) continues to remain an "aspirational target" not only with New Zealand but also with other countries.

90% women view GenAI as crucial for career growth, yet only one-third feel prepared to use it: nasscom-BCG report. Supreme Court rules service tax cannot be applied to lotteries, orders refunds
In an important judgement, the Supreme Court today held that service tax cannot be levied on lotteries as they are actionable claims and not goods.
Setting aside the judgments of the high courts of Kerala and Sikkim, a bench led by Justice BV Nagarathna said that the HCs had lost sight of its earlier judgments that lottery is an actionable claim.
It also asked the concerned departments to expeditiously refund the service tax collected from the companies dealing in promotion, sale and purchase of lotteries. The appeals pertain to the period before July 2010.
With effect from July 1, 2010, a separate entry was inserted in the Finance Act, 1994 to bring the promotion, marketing etc of lottery into the tax net. Prior to this, service tax was levied on sale of lottery tickets by inserting an explanation in Section 65(19)(ii) of the Finance Act, 1994, in the definition of Business Auxiliary Service. This explanation was scrapped in 2010.

"Waqf Board Bahana Hai, Zameen Bechna Nishana Hai": SP chief Akhilesh Yadav attacks BJP
Lashing out at the BJP-led NDA government on the Waqf Act Amendment Bill, Samajwadi Party chief Akhilesh Yadav on Thursday said that in the disguise of amendments, BJP is trying to sell the lands of Waqf Board and instead of 'Janata' in BJP, they should add 'Zameen' in it.
Taking it to a social media post on X, Yadav wrote, "All these amendments of the 'Waqf Board' are just an excuse; Selling lands like defence, railway and Nazul land is the target."
Hitting out at the BJP, Yadav alleged that the amendments in the Waqf Bill were issued in the interest of the BJP and it's just another link in the chain of the schemes that benefit BJP.
The tweet added, "Waqf Board lands are just another link in the chain of 'schemes for the benefit of BJP' after Defence land, Railway land and Nazul land. Why doesn't BJP openly write: 'Issued in the interest of BJP'."

Waqf Amendment Bill Updates: "Bill will usher transparency, accountability" says BJP's CR Kesavan as INDIA bloc questions government on Waqf amendment
The BJP-led government is slated to introduce the Waqf (Amendment) Bill, 2024 in the Lok Sabha on Thursday to amend the Waqf Act, 1995. The bill seeks to "effectively address issues" related to the powers of the State Waqf Boards, registration and survey of waqf properties and removal of encroachments.
Even as the INDIA bloc decided to oppose the bill the BJP lashed out at the Congress and its allies claiming that they were standing in the way of much-needed reform.
"It is a very commendable initiative by the government of PM Narendra Modi, who in response to the various demands and representations made by the affected members of the Muslim community have decided to introduce these amendments. The Waqf Act was enacted by an Act of Parliament in 1954, but the intended objective has not been achieved, which is why there have been so many representations from the affected community. It is very well within the purview of parliament and the deserving, and disadvantaged Muslim members of the community have been denied their rights," BJP national spokesperson CR Kesavan said.
Waqf Amendment Bill Updates: Congress to oppose introduction of Waqf bill
The Congress is set to oppose the introduction of the bill to amend the law governing Waqf boards in the Lok Sabha, sources said on Thursday. Congress MPs K C Venugopal and Hibi Eden have also given notices to oppose the introduction of the Bill in the Lok Sabha.
Eden has said in his notice that he opposes the presentation of the bill as it is "unconstitutional" and cited that it is in conflict with the Right to Property (Article 300A), the sources said.
The Bill can potentially infringe on the property rights of individuals and religious institutions without adequate legal safeguards, he argued.
Eden also contended that the bill is an infringement on the Fundamental Right of Religious Freedom under Article 25, the sources said.
The Bill's imposition of new conditions for creating waqfs and the requirement for existing waqfs to register detailed information on a government portal might be perceived as undue interference in the administration of religious endowments, he said in his notice.
Eden also argued that it is an encroachment on states' powers.

Nancy Pelosi's influence can be seen all across the Democratic Party shakeup that in a few short, agonising weeks has reengineered the 2024 presidential ticket and the race for the White House. It was Pelosi who publicly encouraged President Joe Biden to make a decision about his reelection campaign when he had already insisted he had no plans to step aside. Once he exited and endorsed Kamala Harris atop the ticket, it was Pelosi who was a big fan of her future running mate, Tim Walz. For the House speaker emerita the upheaval is less about Biden, a friend of 40 years, and more about Republican Donald Trump, the former president she refers to as “Bozo,” “a snake-oil salesman,” “what's his name” and the “creature from the Black Lagoon.” “How can I say this in the nicest possible way: My goal in life was that man would never step in the White House again,” Pelosi said, slapping the table with every word.

South Korea's state-run think tank argues for early rate cuts
South Korea's state-run think tank on Thursday said there was a need for early cuts in interest rates, as it flagged weaker economic growth and inflation amid sluggish domestic demand. In its revised economic forecasts, the Korea Development Institute (KDI) said the economy was expected to grow 2.5% in 2024, down from 2.6% seen three months earlier, while keeping its projection for 2025 at 2.1%. Domestic demand is seen remaining weak and delaying the economic recovery, despite stronger growth in exports, according to the think tank.
